sensoryfun.cz – reservations for playrooms, activities, and sales of equipment

These General Terms and Conditions (hereinafter referred to as the “Terms”) govern the rights and obligations between the operator of the website sensoryfun.cz (hereinafter referred to as the “Provider”) and customers (hereinafter referred to as the “Customer”) in connection with booking services, participating in activities, and purchasing products.

An integral part of these Terms is the Privacy Policy, available on the website sensoryfun.cz.

Any translations into other languages are provided for informational purposes only and have no legal effect.

1. About us

Sensory Fun is a family-run initiative based in Brno, Czech Republic, specializing primarily on providing and booking sensory play activities and experiences for children and families in our playrooms. The website allows easy planning and booking of individual sessions and provides all necessary information about the activities. In addition to reservations, we also offer curated sensory tools and materials for purchase that complement the playroom experience.

2. Use of the website

Reservations for services and purchases of products may only be made by persons over the age of 18.

Activities in the playroom are intended primarily for children, with the recommended minimum age of participants being 3 years, unless otherwise stated for a specific event.

The website may only be used for lawful purposes.

The Provider reserves the right to change or temporarily suspend the operation of the website without prior notice.

3. Booking activities in the playroom

Reservations and confirmations

All sessions must be booked in advance via the website. After submitting a reservation, the Customer will receive a confirmation of receipt. The reservation becomes binding only after approval by the Provider, of which the Customer is informed by email.

Payment

Payment for services is made via an external payment gateway (Global Payments). The Provider does not store or process the Customer’s payment details (e.g. payment card or bank account details) and only receives information confirming successful payment.

Cancellation of reservation and cancellation conditions

The Customer may cancel a reservation under the conditions specified for a specific service or event on the website. Unless otherwise stated for the given service, the following applies: cancellation of the reservation sufficiently in advance of the start of the service is free of charge. In the case of later cancellation or failure to attend without cancellation (no-show), a cancellation fee of up to 100% of the service price may be charged.

How to cancel a reservation

A reservation may be cancelled:

  • via the link provided in the confirmation email, or
  • by contacting the Provider by email.

Supervision of children

Children must always be supervised by a responsible adult during activities.

Safety and behaviour

The Provider reserves the right to refuse entry or ask a participant to leave if their behaviour threatens the safety, health, or comfort of other participants.

Age of participants

Activities are intended primarily for children according to the age recommendation stated for the specific service. Adult participants are required to follow the Provider’s instructions.

4. Sale of sensory aids and materials

Order and payment

Products are ordered via the website. Payment is made via an external payment gateway (Global Payments) and is charged immediately. The order is confirmed once the payment has been credited.

Payment processing

The Provider does not store or process the Customer’s payment details (e.g. payment card or bank account details). All payment details are processed exclusively by the payment service provider.

Delivery

Products are delivered within the Czech Republic and to selected EU countries. Delivery times may vary depending on product availability and the selected delivery method.

Withdrawal from the contract and return of goods

The Customer has the right to withdraw from the purchase contract within 14 days of receipt of the goods, provided that the goods have not been used and are returned in their original, undamaged packaging. Products made to order, used products, or products unsuitable for return for hygiene reasons cannot be returned. The costs of returning the goods are borne by the Customer, unless otherwise agreed or if the goods were defective.

Product use and safety

Sensory aids and materials are not toys. They are intended as interactive sensory tools. Products must always be used under adult supervision and in accordance with age recommendations and safety instructions. Some products may contain small parts that pose a choking hazard.

5. Conclusion of the contract

Confirmation of a reservation or order is sent by email.

The Provider is not responsible for damage caused by improper use of products or activities, allergic reactions, or injuries resulting from participation.

6. Cancellation of reservation and withdrawal from the contract

Withdrawal from the contract by the consumer

The consumer has the right to withdraw from a contract concluded at a distance within 14 days of its conclusion, without giving a reason, unless the contract concerns the provision of services within a specific period or the delivery of goods for which the law provides an exception.

Services with a fixed date

For services provided on a specific date or within a specific time frame (e.g., play sessions, workshops, events in the playroom), withdrawal from the contract is not possible if the service is to be provided on a specific date. In such cases, the cancellation conditions specified for the relevant service, as well as Article 3 of these Terms, apply.

Products (sensory aids and materials)

For products purchased via the website, the consumer has the right to withdraw from the purchase contract within 14 days of receipt of the goods, under the conditions set out in Article 4 of these Terms.

Method of withdrawal from the contract

When withdrawing from the contract, the Customer is required to inform the Provider and provide:

  • identification details of the reservation or order,
  • the date of conclusion of the contract,
  • the preferred method of refund, if applicable.

Refunds

If a refund is required, the payment will be refunded using the same payment method as the original transaction, unless otherwise agreed.

7. Intellectual property rights

All content on the website, including text, images, logos, and product designs, is the property of Sensory Fun.

Unless otherwise stated, the owner of the intellectual property rights to the content and the authorized user of the Sensory Fun trade name is:

Any copying, modification, or commercial use of the content without prior permission is prohibited.

8. Protection of personal data

Personal data is processed in accordance with the GDPR and Czech law. For more details, please refer to the Privacy Policy available on the website.

9. Photo documentation and marketing

During activities, the Provider may take photographs or video recordings for the purpose of presenting its services (e.g. on the website or social media).

The use of photographs or recordings depicting identifiable persons, especially children, is permitted only with the prior consent of the child’s legal guardian, in accordance with the Privacy Policy.

The Customer has the right to withdraw such consent at any time in the manner specified in the Privacy Policy.

10. Limitation of liability

The Provider is not responsible for injuries, allergic reactions, or other damage caused by improper use of products or activities.

Participants use the services and products at their own risk.

11. Out-of-court settlement of consumer disputes

If a consumer dispute arises between the Provider and the consumer from a contract concluded via the website and cannot be resolved amicably, the consumer has the right to seek an out-of-court settlement.

The competent authority for out-of-court settlement of consumer disputes is:

The consumer may submit a proposal for out-of-court dispute resolution no later than one year from the date on which the consumer first exercised the right that is the subject of the dispute with the Provider.

Consumers may also use the Online Dispute Resolution (ODR) platform established by the European Commission.

Out-of-court dispute resolution is free of charge; the consumer bears only any costs related to their own representation or expert opinions.

12. Final provisions

These Terms are drawn up in the Czech language.

In the event of translation into other languages, the Czech version shall always prevail and be legally binding. Translations into other languages are provided for informational purposes only and have no legal effect.

13. Changes to the Terms and Conditions

The Provider reserves the right to amend these Terms. Continued use of the website or services constitutes acceptance of the current version of the Terms.

The Provider primarily communicates with Customers electronically. The Customer agrees that responses to inquiries, reservation confirmations, service changes, or other important information may be sent by email.
